The questions directors ask first

Does talking to you start a formal insolvency process?

No. The first conversation is advice only. Nothing is filed, no creditor is told, and no process begins unless you instruct it.

Can I keep trading while we work out what to do?

Often yes. Where the company is insolvent we will be clear about your duties while you do, so nothing catches you out later.

Will I be personally liable for the company's debts?

Usually not. The exceptions are personal guarantees, an overdrawn director's loan account, unpaid share capital and certain conduct findings. We check each of those with you.

Can I start again with a new company?

In most cases yes, provided the rules on re-using a name are followed and any assets are bought from the liquidator at a proper value.

I have received a winding-up petition. How urgent is it?

Very. You normally have about seven business days before it is advertised, at which point the bank account is usually frozen. Call the same day it arrives.
